Attorney Fang-An Ouyang Completes Ministry of Labor Training and Is Included in Taiwan's Workplace Sexual Harassment Investigation Professionals Database

Attorney Fang-An Ouyang of Wen Hui Attorneys at Law has successfully completed the Ministry of Labor's 2024 Training Program for Legal Professionals Conducting Workplace Sexual Harassment Investigations and has been included in the Workplace Sexual Harassment Investigation Professionals Database established by the Ministry of Labor.

 

Following the amendments to the Act of Gender Equality in Employment, which took effect on 8 March 2024, employers are expressly required to establish complaint procedures and, upon becoming aware of an allegation of workplace sexual harassment, to take immediate and effective corrective and remedial measures. One of the most important obligations imposed on employers is to promptly investigate the relevant facts in an objective, impartial, and professional manner.

 

The Regulations for Establishing Measures for the Prevention and Correction of Sexual Harassment in the Workplace further require employers with 30 or more employees to establish a complaint-handling unit composed of professionals with gender equality expertise. The purpose is to ensure a fair and effective investigation process and to strengthen the prevention of future workplace sexual harassment.

 

Because incidents of sexual harassment frequently occur in private settings and often involve sensitive issues concerning the parties' personal dignity and privacy, workplace investigations require specialized expertise and careful handling. Every stage of the investigation—including the initiation of the investigation, evidence gathering, and interviews with the complainant, the respondent, and relevant witnesses—should be conducted by professionals with gender sensitivity and appropriate training. Such an approach helps establish the facts, minimizes the risk of secondary victimization of the complainant, safeguards the reputation and due process rights of the respondent, and promotes a respectful and harassment-free workplace.

 

To assist employers in handling workplace sexual harassment complaints, the Ministry of Labor has established the Workplace Sexual Harassment Investigation Professionals Database, which contains qualified professionals available to participate in workplace investigations.

 

Attorney Fang-An Ouyang specializes in employment law and gender equality matters. She previously served as an assistant to the Taipei City Government's legal team in the constitutional interpretation leading to Judicial Yuan Interpretation No. 748, which recognized same-sex marriage in Taiwan. She has also advised on and conducted internal corporate investigations.

 

Attorney Ouyang completed the Ministry of Labor's training program on 17–18 May 2024 and has been formally included in the Ministry's Workplace Sexual Harassment Investigation Professionals Database. She is now qualified to assist employers and organizations in conducting independent, fair, and professional investigations into workplace sexual harassment complaints.
